Dear Michael,
Thank you for your email relaying the incident which occurred on Thursday
21 Aug. The situation which is alleged to have taken place was certainly
one that was potentially quite dangerous and illustrated an apparent lack
of due diligence & awareness of other road users by the driver
responsible. The incident highlights Centennial Parklands' concerns as to
the need for greater compliance by all park users with respect to it's own
regulations and the laws in general to ensure public safety due to the
ever increasing demands & popularity of Centennial Parklands.
As the matter was not witnessed and the driver not spoken to by an
Authorised Person of the Trust it does make further action by Centennial
Parklands difficult. Until recently Centennial Parklands as a client of
the Infringement Processing Bureau (NSW Police Service) could obtain the
basic details of the registered owners of vehicles, the drivers of which
had breach the Centennial Park & Moore Park Trust Regulations 1999.
This would permit action where applicable to be taken. As of April this
year the responsibility for providing this information has been
transferred to the Road & Traffic Authority (RTA). The application process
for client agencies and organisations to gain approval to obtain this
information due to it's sensitivity is extremely rigorous. At this time
Centennial Parklands does not have approval and therefore unable to
taken further direct action of it's own accord. The matter will however
be recorded on our database of incidents.
I will forward your email to the Eastern Beaches Police Local Area Command
(Maroubra) who are responsible for the area in which the incident
occurred. You may wish to report the incident to them of your own accord.
To pursue the matter further will require you and other witnesses to be
formally interviewed and statements taken in the event that matter results
in a defended court appearance and witnesses are required or are
subpoenaed to attend court to give evidence.

Dear John,
Thank you for your email of the 23 August and bringing various matters to
my attention.
As you have correctly indicated it is a breach of the Centennial Park &
Moore Park Trust Regulations 1999 to both learn and teach a person to learn
how to drive a vehicle on Trust lands. Where matters such as this
are witnessed and the offender spoken to by an Authorised Person of the
Trust the person can be issued with a Penalty Notice, however this was not
the situation on this occasion. Until recently Centennial Parklands
as a client of the Infringement Processing Bureau (NSW Police Service) could

Action can be taken with respect to the incident which is alleged to have
occurred in the toilets near Hamilton Drive where the offence of 'Behave in
Offensive/Indecent Manner' under Cl 22 (b) of the Centennial Park & Moore
Park Trust Regulations 1999 can be established. With respect to this I would
urge the alleged victim to report the matter in full to Centennial Parklands
so that the matter can recorded and if sufficient details can be provided
that would establish the identity of the alleged offender a prosecution may
be initiated. I would also urge the person concerned to report the incident
to the police to bring the matter to their attention. Centennial Parklands
Rangers frequently patrol the toilets. It has also been brought to the
attention of local
police for assistance.
The issue of excessive speed by vehicles traveling on Trust lands and in
particular compliance in Centennial Park itself where a 30kph speed limit
applies ranks high with respect to both the concerns by Centennial Parklands
for public safety and in the number of complaints from a broad range of park
users. Traffic studies have indicated that the area where you observed the
ranger to be parked as a high speed problem area.
Rangers taking a proactive stance in attempting to educate park users to
comply with the laws is commended.
Perhaps in future similar circumstances when either you or your members
observe incidents of non-compliant or offensive behaviour and are aware of
the location of a Centennial Parklands Ranger you actually bring this
matter to their attention at that time. This perhaps may assist in a
speedier and more effective outcome.
